NATAL CANOE CLUB GENERAL INDEMNITY

1. I hereby declare, that by checking the relevant box on the website, I have read and understand the terms and conditions of the "General Indemnity" as contained herein, and accept these terms and conditions.
2. I declare that I am the person stated in the registration form contained on the NCC website, and that, to the best of my knowledge, the information entered onto the website is accurate and complete.
3. I am aware of the potential dangers involved to which I will be exposed by participating in canoeing and associated activities.
4. I undertake to wear a buoyancy jacket that conforms to the requirements of Canoeing South Africa and affiliated Unions, if I do not qualify for the exemption.
5. I understand that the information I provide when registering on the NCC database may be used to register me with Canoeing South Africa and affiliated Unions:
   1. I hereby consent to my information being provided to CSA and affiliated Unions.
   2. Agree that my acceptance of the Natal Canoe Club General Indemnity is applicable to all CSA and affiliated Union events.
   3. Any fees becoming due or payable to CSA and affiliated Unions will be governed by the rules applicable to fees due and payable to NCC.
6. I am further aware that Canoeing South Africa and its affiliated Unions, and all subordinate bodies and officials as well as sponsors of events, in organizing and permitting my participation in such activities and in establishing and enforcing safety measures in regards thereto, cannot ensure my safety and/or the adequacy of such measures.
7. As such, I undertake to:
   1. participate in all canoeing and associated activities at my own sole risk and responsibility;
   2. exonerate all persons and bodies involved in the organisation and sponsorship of canoeing under the auspices of Canoeing South Africa and affiliated Unions from, and indemnify them against, any loss or damage which I or any others, including my dependants, may suffer as a result of any injury or death resulting from any act or omission on the part of such body or person, whether due to negligence (including gross negligence) or otherwise;
   3. comply with all safety and other rules and regulations of Canoeing South Africa and all affiliated Unions and subordinate bodies.
8. By my acceptance hereof, I fully understand and accept that upon registration I will be registered with the NCC and any affiliate bodies database, and undertake all activities and obligations as a result of my registration with the NCC and any affiliate bodies database entirely at my own risk.
9. I agree that NCC and any affiliate bodies' liability to me, my estate, my dependants or any other person in respect of any claims arising from loss or damage to property owned by me or in my possession or under my control or from bodily injury to me or from my death shall be limited to the extent to which such claims are covered and met by NCC and any affiliate bodies' insurance. Thus, save to the extent that any claim (or part thereof) may be covered and met by NCC and any affiliate bodies' insurance. I hereby release, indemnify and absolve NCC and any affiliate bodies, its Council, its staff, it's sponsors, its agents, representatives and all persons for whom it is vicariously liable against any and all claims whatsoever which claims may be made by me, my estate, my dependants or any other person arising from loss or damage to property owned by me or in my possession or under my control or from bodily injury to me or my death regardless of the nature or cause of such loss, damage, injury or death and regardless of whether it be caused by the negligent act or omission of the NCC and any affiliate bodies, its Council, its staff, its agents, representatives or other persons for whom it is vicariously liable. I understand the nature and extent of this release.
10. I shall, whilst registered with the NCC and any affiliate bodies database, abide by all the rules and regulations of the database currently in force and as amended from time to time.
11. In the event of fees becoming due and payable, I undertake to make payment of all fees and charges on or before the date upon which payment thereof is finally due, and I otherwise accept and undertake to abide by the conditions relating to payment of fees and charges and deregistration. Should I fail to make timeous payment, NCC and any affiliate bodies shall be entitled to charge, and I accept liability to pay, interest on the amount due at the prevailing interest rate applicable to incidental credit agreements from time to time as provided for in the National Credit Act, 34 of 2005.
12. I understand and accept that if fees and/or any other monies I owe to NCC and any affiliate bodies are not paid in full and/or other property on loan from NCC and any affiliate bodies is not returned then, notwithstanding anything to the contrary, NCC and any affiliate bodies reserves the right to, inter alia, withhold my registration and participation of NCC and any affiliate bodies events until such time as I fully meet these commitments.
13. I undertake to pay all legal costs incurred by NCC and any affiliate bodies as between attorney and own client, including collection charges, if any, with regard to instructions given by NCC and any affiliate bodies to its attorney for the recovery of any arrear fees and/or other charges due irrespective of whether or not legal action is actually instituted against me.
14. I am aware that my registration may be cancelled by NCC and any affiliate bodies if such registration fails in any way to comply with the regulations of NCC and any affiliate bodies.
15. I warrant and declare that all information and particulars furnished on this website are true and correct. I hereby acknowledge that a breach of this warranty constitutes a material breach of the agreement which will entitle NCC and any affiliate bodies, without prejudice to any other rights or remedies which it may have, to cancel my registration with the NCC and any affiliate bodies database.
16. I understand and accept that this undertaking and indemnity will operate as a continuing undertaking and indemnity and cover all my periods of registration with NCC and any affiliate bodies. I further understand and accept that I may still be required to register at the commencement of each relevant period.
17. I do hereby acknowledge:
    1. that the information provided by me can and may be used for the administration of various sporting events.
    2. that this "General Indemnity" is applicable to any event which subscribes to the administration procedures of NCC and any affiliate bodies, and which has agreed to abide by the rules governing the administration of events as prescribed from time to time by NCC and any affiliate bodies.
    3. that my general health is good and there is nothing which renders me unfit to undertake an activity in which I participate as a result of my association with NCC and any affiliate bodies or its database.
    4. that I understand and appreciate fully the fact that there may well be risks, hazards and dangers involved in events to which I would be subjected.
18. I shall participate in all competitions or events in a sporting and fair manner. I shall submit to disciplinary measures taken against me and shall take any appeals and litigation before the authorities provided for in the Regulations. I accept the Court of Arbitration for Sport (CAS) as the sole competent body for appeals in such cases and under the conditions set out in the regulations.
19. I agree to submit to and be bound by the official Antidoping Regulations of the body to which the event is associated, the clauses of the World Antidoping Code and its International Standard and to the Antidoping Regulations of other competent bodies as per the regulations of that code. I have received and had an opportunity to review the ICF Anti-Doping Rules. I agree that the results of the analysis may be made public and communicated in detail to my club or team or to my Paramedical Assistant or Doctor. I agree that all urine samples taken shall become the property of the body to which the event is associated which may have them analysed, especially for purposes of health protection research and information. I agree that my doctor or the doctor of my club or team may, on a request from that body, communicate to it a list of any medicines I may take and treatment I may undergo before any given competition.
    1. I consent and agree to comply with and be bound by all of the provisions of the ICF Anti-Doping Rules, including but not limited to, all amendments to the Anti-Doping Rules and all International Standards incorporated in the Anti-Doping Rules
    2. I acknowledge and agree that National Federations and the ICF have jurisdiction to impose sanctions as provided in the ICF Anti-Doping Rules.
    3. I also acknowledge and agree that any dispute arising out of a decision made pursuant to the ICF Anti-Doping Rules, after exhaustion of the process expressly provided for in the ICF Anti-Doping Rules, may be appealed exclusively as provided in Article 13 of the ICF Anti-Doping Rules to an appellate body for final and binding arbitration, which in the case of International-Level Athletes is the Court of Arbitration for Sport.
    4. I acknowledge and agree that the decisions of the arbitral appellate body referenced above shall be final and enforceable, and that I will not bring any claim, arbitration, lawsuit or litigation in any other court or tribunal.
20. I accept the conditions regarding blood testing and accept to undergo blood tests.
21. I warrant that if I am a minor (under the age of 18 years) at the time of registering with NCC and any affiliate bodies, that I have informed my Parent or Legal Guardian of my intention to register with NCC and any affiliate bodies, and that my Parent or Legal Guardian has completed the relevant section of my NCC and any affiliate bodies registration.
22. I hereby waive whatever claim/s I may have at any time and howsoever arising against NCC and any affiliate bodies and/or it's officials/members, employees, servants, agents, assistants, sponsors, landowners and the organisers of any sporting event at which I may compete, held under the auspices of NCC and any affiliate bodies in respect of or arising out of, whether directly or indirectly, use of the data on the NCC and any affiliate bodies database for any bodily injury which I may suffer or any damage to any property which I may have legal interest, whether such damage or loss or injury was caused partly or wholly by the negligence albeit gross on the part of any one or more of the parties referred to above or any part for whom they may be vicariously liable.
23. I acknowledge that my personal data may be used by others, whether authorised by me or not, to enter me into an event/s, and that such use of my personal data constitutes my acceptance of the rules of that event. Additionally, by participating in such event due to the use of my data on this website, I hereby release and discharge the organisers of any such event, all sponsors and any and all volunteer groups from all claims for injury, damage or property loss I/we may suffer as a result of the negligence of any of them and arising out of my/our participation in the event, including the Dusi Canoe Marathon.
